What is regulated in these Terms and Conditions?
These Terms and Conditions reflect the business operations of PT. Mitra Pasifik Solusindo, the applicable laws in our company, and what we believe to be true. As a result, these Terms and Conditions help define the relationship between PT. Mitra Pasifik Solusindo and you when you interact with our services. By using our services, you acknowledge that you have agreed to and are bound by these terms. Therefore, we hope you read these terms carefully and ensure that you understand them. In addition to these terms, we also publish a Privacy Policy.
  1. Definitions
    1. "OnTime Payroll", “We”, and "Our" refer to PT. Mitra Pasifik Solusindo, which provides this platform/site service.
    2. "Site" and "Service" refer to any website, portal, or mobile application owned and operated by OnTime Payroll and its affiliates/subsidiaries or service providers, including but not limited to:
    3. Provision of online sites, including services for managing and/or processing employee data and/or creating OnTime Payroll profiles and Company profiles that may include personal information;
    4. Provision of lending services to employees/companies, including company fixed loans, company flexible loans, and loans with third parties;
    5. "Application" means a mobile-based application owned and operated by OnTime Payroll and its affiliates/subsidiaries.
    6. "You", “Your”, "User," and "General User" herein refer to all individuals and/or entities accessing and/or using the Site at any time for any reason or purpose.
  2. Registration
    1. You must ensure that the details and/or information you provide during registration or at any time thereafter are accurate and complete.
    2. Any changes to the information you provided during registration must be promptly communicated to us by updating your personal details so that we can effectively communicate with you.
    3. OnTime Payroll is not responsible in any way if users or other users violate the Terms and Conditions, use your personal data, information, or materials for purposes other than managing your employee data.
    4. You acknowledge that all personal data, information, or materials provided to OnTime Payroll or other users, or submitted on or through the Site, are entirely at your own risk.
  3. Passwords and Security
    1. You must carefully maintain the confidentiality of your password and not disclose it to any party. You are fully responsible for maintaining the confidentiality, storage, and security of your password and must immediately notify OnTime Payroll if there is any unauthorized use.
    2. If OnTime Payroll has reasonable grounds to believe that there is a possibility of security breaches or misuse of the Site, we may ask you to change your password, or we may suspend your account.
    3. You are responsible for all losses or damages suffered by you due to the loss of your password or the misuse of the Site.
  4. Availability of OnTime Payroll Site
    1. OnTime Payroll will offer the best services to you. However, OnTime Payroll cannot guarantee that all services will meet all your needs.
    2. OnTime Payroll does not guarantee that the Site will be free from problems, viruses, or other harmful mechanisms. If there are errors on the Site, you should report them to OnTime Payroll as soon as possible.
    3. OnTime Payroll does not guarantee that the reliability, timeliness, quality, suitability, availability, accuracy, completeness, or security of the Application can meet your needs and expectations.
    4. Your access to the Site may be restricted at times for repairs, maintenance, or the introduction of new content, facilities, or services.
  5. The use of the Application and Services
    1. OnTime Payroll hereby grants you a non-exclusive, limited, and revocable right to access and use the Site solely for personal use and/or for the purpose of managing your company's data.
    2. You have full freedom to choose whether to use the Application or other applications, use the available Services or not, or to stop using the Application and Services at any time.
    3. You are not allowed to use the Site for the following purposes:
      1. Disseminating content or materials that violate the law, threaten, harm, are vulgar, obscene, abusive, defamatory, or contain other materials prohibited by law.
      2. Transmitting material that encourages criminal behavior or otherwise violates applicable laws, regulations, or ethical codes.
      3. Interfering with other users' use of the OnTime Payroll Site.
      4. Copying, storing, or electronically transmitting copyrighted material without the permission of the copyright owner.
      5. Collecting, copying, or duplicating in any way the content of OnTime Payroll or information available on any Site.
      6. Distributing OnTime Payroll content for general use.
      7. Reverse-engineering the system or decompiling any part of the OnTime Payroll Site.
      8. Registering profiles or company data on behalf of others.
      9. Sharing your account login credentials with third parties.
      10. Accessing unauthorized data or accessing servers or accounts that you are not authorized to access.
      11. Requesting or obtaining passwords or personal identity information from other users.
      12. Attempting to disrupt services for any user, host, or network, including but not limited to:
        1. Sending viruses to the OnTime Payroll Site.
        2. Performing actions such as server overloading, flooding, spamming, or crashing.
        3. Launching botnet attacks on OnTime Payroll servers.
    4. Violations of network security may result in civil and/or criminal liability. OnTime Payroll will investigate any potential incidents related to such violations and may involve and/or cooperate with law enforcement authorities in prosecuting users involved in such violations.
  6. Problem resolution and disputes
    1. If you experience system disruptions, become aware of or suspect that your Account has been hacked, used, or misused by others, or if your personal device is lost, stolen, hacked, or infected with a virus, please report it to us immediately so that we can take necessary action to prevent any potential use, misuse, or loss.
    2. Your Account may be temporarily or permanently suspended for reasons including, but not limited to, the following:
      1. Your report that your account is being used or suspected of being used or misused by someone else.
      2. Your report that your personal device is lost, stolen, or hacked.
      3. We know or have sufficient reason to suspect that your account has been transferred or used by someone else.
      4. We know or have sufficient reason to believe that events have occurred that, in our view, have or may harm us, you, Service Providers, or other parties.
      5. Our system detects unusual actions regarding your Account or non-compliance with the Terms of Use and/or Privacy Notice by you.
      6. You have passed away, been placed under guardianship or conservatorship, or are otherwise legally incapacitated under applicable laws and regulations.
      7. An order to freeze your account, either temporarily or permanently, issued by relevant government or monetary institutions or based on a court order issued in accordance with applicable laws and regulations.
    3. If your Account is frozen, and you have clear evidence that your Account should not have been frozen, you can file a Report with us, attaching the supporting evidence. We will further examine your Report, and based on our policy, we will determine whether to terminate or continue the freeze on your Account.
    4. OnTime Payroll is not responsible for downloading and using the Application on rooted or jailbroken devices, and your use of such devices is entirely at your own risk. You understand and agree that OnTime Payroll is not liable for any loss or other consequences suffered or caused by you as a result of using the Service on rooted or jailbroken devices, and we have the discretion to terminate your use of the Service on such devices and block rooted or jailbroken devices from accessing the Application.
  7. Other matters to consider
    1. You understand and agree that these Terms constitute an agreement in electronic form, and your decision to use Our Services represents your active consent to enter into an agreement with Us, thereby making these Terms and Privacy Policy legally binding and enforceable throughout your use of the Application and Services.
    2. If any provision of these Terms is deemed unenforceable, it shall not affect the enforceability of the other provisions.
    3. OnTime Payroll reserves the right to update, revise, modify, or amend these Terms at any time deemed necessary by OnTime Payroll. If OnTime Payroll decides to update, revise, modify, or change these Terms, OnTime Payroll will post such changes on the Site and/or any other appropriate location determined by OnTime Payroll.

Privacy Policy
This privacy policy ("Policy") governs how we, PT. 
Mitra Pasifik Solusindo and/or our affiliated entities ("Pasifik Sukses Gemilang Group" or "We"), collect and process your data in our Services. We respect the privacy of your personal information and data and will ensure the compliance of OnTime Payroll staff with the strictest standards of security and confidentiality regarding all the personal information and data you submit through the OnTime Payroll Application and OnTime Payroll Site. We will not, based on the terms herein, disclose such information to anyone without your prior consent.

By using the Services, you acknowledge that you have agreed to and are bound by the provisions contained in this Policy. Therefore, we encourage you to read this Policy to ensure that you understand how we handle your Personal Data.


1. The scope of information we collect about you
We collect Personal Information when you use our Services. We also collect device and technical information from you, as well as other information that you may provide when using our Services. If you choose not to provide such information, we may not be able to provide the Services to you normally.
The following are the scope and types of Personal Data about you that we will process in connection with the use of the Services:
a. Identity Data, including but not limited to, name, email, identity number, phone number, address, biometrics, and others
b. Financial Payment Data, including but not limited to, bank account numbers, financial information, and others
c. Activity Data, including but not limited to, transaction input and processing, display and interaction with content, employee data input and processing, and others
d. Location Data, location information is collected when you use Our Services. Location will be determined using GPS, IP address, and the like.
e. Face Data(Optional), Face data 
image that you take and upload from the app to use the Clocking feature, which is to prove that you are using Clocking and not someone else, so that fake Clocking does not occur.
 
2. Use of Your Personal Data
The information collected about you will be used to:
a. Provide the Services to you
b. Register you as a user and manage your account
c. Communicate with you about systems connected to us
d. Send you information related to the use of the Services
e. Offer or provide Services from our affiliates or partners
f. Monitor and analyze your activities in using our Services
g. Provide assistance and resolve complaints regarding operational issues with the Services
h. Help improve the security and reliability of our services
i. Comply with all obligations under applicable laws, including but not limited to responding to requests, investigations, or regulatory directives from any government entity
j. Other purposes that we notify you of, and/or as required by Applicable Law, for which we will obtain your consent

 
3. Sharing Your Personal Data with Third Parties
We will not share, sell or rent out your Personal Data to any third party.

We reserve the right to reject your requests for access to, correction of, and/or deletion of all or part of your Personal Information that we possess and control if permitted or required by applicable laws and regulations. This includes situations where the Personal Information may contain references to other individuals or where the request for access or the request for correction or deletion is deemed by us to be irrelevant, frivolous, or burdensome. Subject to applicable laws and regulations, we reserve the right to impose administrative fees for any access and/or correction requests.
 
5. How long will your personal data be stored?
We store your data for different periods depending on the type of information:
Your profile information will be stored for the duration of your active account.
For data stored during your use of the Services, it will be retained for a maximum period of 24 months.
If you violate the Terms and Conditions and your account is suspended, we will retain your account data, such as email address or phone number, as a preventive measure to prevent violators from creating new accounts.
We will retain information for a longer duration than stated in this Policy if required by applicable laws and regulations or for security reasons.


6. Delete Account
By using in app feature you can delete all your personal data in order to stop sharing your privacy.
